COUNT I

THE ABOVE-NAMED COMPLAINING WITNESS BEING DULY SWORN SAYS THAT THE ABOVE-NAMED DEFENDANT(S) IN DANE COUNTY, WISCONSIN DID, on September 4, 1997, at the CITY OF MADISON, knowingly obstruct City of Madison Police Officer Cindy Thiesenhusen and City of Madison Police Detective Tom Woodmansee, while such officer(s) were doing an act in an official capacity and with lawful authority, to wit:

conducting an investigation contrary to Section 946.41(1) of the Wisconsin Statutes, a Class A misdemeanor; punishable by a fine not to exceed $10,000 or imprisonment not to exceed nine (9) months, or both.

FACTS: Your complainant is a detective for the City of Madison Police Department and for this complaint is relying on the written reports of City of Madison Police Officer Cindy Thiesenhusen and City of Madison Police Detective Tom Woodmansee. Officer Thiesenhusen reports that on September 4, 1997 she went to 7XX Fairmount Ave., City of Madison, Dane County, Wisconsin where she contacted an individual who verbally identified herself as Patricia XXXXX. XXXXX told Officer Thiesenhusen that prior to the officer arriving she had been sexually assaulted while in her bedroom at the above address. XXXXX reported the following incident to Officer Thiesenhusen. XXXXX was in her bed when a male came into her room with a serrated knife and sexually assaulted her by putting his penis in her anus. Then the suspect ordered XXXXX to "suck him" and he put his penis in her mouth. The suspect asked XXXXX to put a condom on his penis and she complied. Then the suspect penetrated her vaginally. Prior to leaving, the suspect made XXXXX go into a closet and then he left.

Detective Tom Woodmansee reports that on September 9, 1997 he contacted Patricia XXXXX at her residence. XXXXX showed Detective Woodmansee her bedroom and told him that is where she had been sexually assaulted. Detective Woodmansee further reports that he spoke to XXXXX for over 3 hours, during which she gave him a detailed accounted of the sexual assault which she said occurred on September 4, 1997.

Detective Woodmansee reports that on October 2, 1997 at approximately 2:00 p.m. XXXXX came to the City of Madison Detective Bureau. Detective Woodmansee reports that he and Detective Draeger spoke to XXXXX. Detective Woodmansee reports that he told XXXXX he believed she had falsely reported the September 4, 1997 sexual assault and XXXXX said, "Okay, I'm lying." XXXXX further admitted that she did not know why she made up the assault and said, "I'm sorry, I'm very sorry. I didn't mean for this to happen." Detective Woodmansee asked XXXXX if she intentionally cut herself on the finger with a knife on September 4, 1997 and she admitted that she had. Detective Woodmansee also asked XXXXX if she intentionally scraped her neck with the knife and she admitted that she had. Detective Woodmansee asked XXXXX to estimate the number of times she spoke to him and lied to him and XXXXX said she spoke to him three different times. Woodmansee asked XXXXX if she lied to him every time and she said, "yeah."

**THIS COMPLAINT IS BASED ON the information and belief of your complainant, who is a detective for the City of Madison Police Department, and who learned of the above offense from the reports of City of Madison Police Officer Cindy Thiesenhusen and City of Madison Police Detective Tom Woodmansee which report(s) your complainant believes to be truthful and reliable inasmuch as they were prepared during the course of the officer(s) official duties.

Your complainant believes the statements of the Defendant to be truthful and reliable insofar as they are admissions against penal interest.
